| 内容記述 | わが国における戦争に時代には医療事故は起きていたにもかかわらず医療紛争はなかった。そこには、御国の為という教育の時代的背景があった。現代の患者意識の高揚は医療事故が発生し悪い結果が起きた場合は医療過誤訴訟に持ち込まれる傾向が多い。医療事故の中でで公表されるものは氷山の一角といわれ、表面に現れるのはほんの一つまみである。かつて医療側主導のわが国でも1970年代より訴訟大国米国の影響を受け、1980年代の日本では医療過誤訴訟が表面化した。そこで、認容率は原告勝訴率であり、命の価値観や後遺障害に対する損害賠償のとらえ方等にも変化がみられた。小稿では周産期をめぐる医療過誤訴訟に焦点を当て、争点を明らかにすることでコ・メディカルの視点で医療体制が強化された動機付けを示した。 | |||||

| 内容記述 | In spite of many medical accidents, there were no medical troubles on the Second War era in Japan. Now, many of Japanese tend to enter the lawsuit when they suffer worse result by the medical accidents. It shows us that Japanese almost recognize the rights of patient. But, it is true that the medical accidents made public are the tip of the iceberg. Japan which medical had the initiative were influenced by America which had liked to enter lawsuit in 1970's, and then the medical negligence lawsuits had come to light in 1980's. Further, the sense of values about the life and the viewpoint of the indemnity against the damage was changing.The purpose of this paper is to make the issues of the Medical Negligences in Perinatal cases clear, and then to show the motivations that we should establish the safety medical treatment and care from the standing of the co-medical staff. | |||||
